well, yes, 5 could end in a tie of 5vs5, and then it wouldn't end in a lynch, however if I were to switch to Scifiboy, like axumblade suggests, it would be 5/4/1 which would end in a lynch.

Is that how it works?  I thought it just had to keep going until someone managed a majority.
