When you're saying 'upscaling,' I think you're meaning rendering at a higher resolution which is completely different. The problem is when this happens it often throws the timing off within the game and has to be emulated. Being 100% bw compatible while rendering at a higher resolution is not possible. If you've played dolphin or any other emulator it requires a much higher spct to emulate properly and when it does it's not perfect. Nintendo 'could' do this but it's not easy, xbox 360 doesn't emulate old xbox games at higher resolutions, ps3 doesn't emulate old ps2 games for the same reason it's very very difficult to do accurately.
