When you download / copy an iso your are "taking of another person's property without that person's ... consent". YES you are.

As I said many times, while you are making it sound better by following the strict difference of theft and copyright infringement as detailed by the world's courts, in general terms and the terms any non lawyer would use to describe the situation, it is theft.

Piracy is akin to theft. Pirates are thieves.

No you aren't taking someones property without their consent.
