It won't stop piraters obviously, but it may make some Japanese gamers think twice about whether or not they really want to keep their rom sites up. I mean hell, if I was making virtually no money by running a pirate site and there was even a chance of getting a huge fine and jail time my risk benefit analysis would quickly favor shutting down my site. I've been to rom sites, I can't imagine they are profiting that much off of running hentai and diet pill ads. But then again stupid criminals are stupid, and probably wouldn't have much of a risk benefit analysis process.
Either way it is illegal, so it's well within Nintendo's rights to prosecute to the full extent of the law. You can say it's a victimless crime, you can justify it, or what have you, but it's still Nintendo's right to prosecute those breaking the law. And honestly, I'd much rather companies actually prosecute pirates rather than shove annoying DRM onto disks that punishes only the honest customers.
