Konami made the oldskool Arcade/NES games

Ubisoft owns the publishing rights now

So Konami gives the code to Ubisoft who publishes TMNT1 on Wii VC. You pay an extra 100 points to download it, to cover the licensing fees.

 

 Sounds like to get Goldeneye

Rare gives the code to Activision who publishes Goldeneye on Wii VC, probably paying  200 points for licensing fees.
