None of the other games have attempted to be faithful. This will be the first one. It is trying to give you some wiggle room, as you're only locked into playing two characters depending on which side you choose (Iron/Mr. Fantastic or Captain America/Luke Cage), and the rest you get to choose which side they play for. So yes, some characters not part of the storyline are going to be playable. However, there's a difference with having living characters getting involved, and having dead characters getting involved. I'm not gullible regarding comic characters staying dead, however, Jean's been dead for years, is currently dead, and was dead during Civil War. That's enough reason to omit her from the game considering how many other characters can take her place.
Regarding Thanos and Apocalypse, it probably has more to do with how overpowered they are than anything else.
I'm not going to refute your point about the Hulk, because it's valid. However it should be obvious that the Hulk is more an exception because of his popularity and the developers are otherwise trying to stay a bit faithful to the Secret War and Civil War storylines.
If it makes you feel any better, I don't think any other characters that were deceased at the time are present in this game either.
