I say if we're going to ban people from posting their thoughts, then the question of free speech is relevant. If we're talking about banning based on a person's character and actions outside of the forum, then privacy matters are relevant, along with what responsibilities we have in the first place. If we're talking about judging and banning people for crime, giving them a fair trial and being able to provide evidence is relevant. And you're right, this all is a royal pain in the ass, and IS IRRELEVANT to what we want to do, which is to talk about video games.
So can we please just talk about video games? I don't mind if we ban people who post "How to" threads on modding consoles and such, but to simply ban them for doing it in their personal lives, outside of the forum? If someone pirates, and admits it, even advocates it, it's fine. Just don't host the actual illegal activities here. Discussions about piracy is relevant if its in the Offtopic, Website, and any other non-gaming forum.
Should we prevent VGC from influencing the spread of [insert illegal activity here] negatively? No. It's not our jobs.
