Depends on specific patents. This's quite complicated issue, afaik until 2003 all Famiclones were illegal. Though there're one licensed clone - Twin Famicom made by Sharp. Can't say about Retro Duo, Wiki says it's an "emulator", not an actual hardware clone. My guess, they're selling "emulator" machine to avoid breaking Ninty patents.
