I guess that the hardware does not need to be licensed by nintendo. If that thing does not break any patents of nintendo, it should be legal. :P

Depends on specific patents. This's quite complicated issue, afaik until 2003 all Famiclones were illegal. Though there're one licensed clone - Twin Famicom made by Sharp. Can't say about Retro Duo, Wiki says it's an "emulator", not an actual hardware clone. My guess, they're selling "emulator" machine to avoid breaking Ninty patents.

I swear I read this somewhere and just-so-happened to copy and paste it for this very day:

"Unfortunately, in order to avoid copyright infringements, we had to make the controller cord so small you are required to sit on top of the console to play. We're sorry for any inconvenience this may cause. If you're playing a multi-player game, we recommend playing with someone of the opposite sex because they will be required to sit on your lap."
