I dont know, but I think Nintendo doesnt care has much has before. Before, the homebrew channel was removed everytime you did a firmware update. Since the new version (4.0), the homebrew channel will stay when you upgrade. But, theres still no new twilight hack for the system menu 4.0.
The only thing that Nintendo hates is people that hacks during online games with other people that doesnt hacks. For Brawl+, people play friendly match with the same codesets because normal random matchmaking will get you desynchronized most of the time (all of the time).
