Saying that people could have tried it on xbox live is the exact kind of argument that the decision makers used in promoting this video. It's not about how many people use xbox live, it's about deliberately misleading the consumer, whether it did or not.

I couldn't find it, but there is another trailer with review scores on it like "5 out of 5 stars" and shows the same clip. I wanted to see if it mentioned the word shooter or something, as it has replaced the original commercial, which as someone pointed out, does not show what the game actually is, though it's pretty evident.
Guys shooting each other can only be a couple of genres. Even if it was survival horror, or third person like metal gear, at least it's not a completely different kind of game. :P
