When Rare and Nintendo split they had to resolve a tons of IPs cross-right ( in the case of DK , Rare created all the characters post Donkey Kong Country. Even the currently official design of the character Donkey Kong was done by Rare. )

When Rare departed Nintendo keep for themselves the right on all the work Rare did on the Donkey Kong IP.

 

 

whatdo u mean better than me look at this if microsoft were tto let say gearbox make the next halo and then made a new character would that mean they own the ip no it just means that ms has a new character.nitendo wanted a new  dk game so they let there most talented studio create it so they let rare use the ip they in  no way owned it.Rare left nitendo because they were not having the freedom they wanted'rare themselves said that they were worried that if they had brought the idea of viva pinatas up to nitendo they were worried that they were going to be turned into pokemon.And for all u haters out there rare helped bungie make halo 3
