Nintendo owning the patent on the Sanity Meter itself would keep SK from doing anything with the property even if they owned the IP outright unless they completely did away with it but that's like getting rid of the football in a football game.
If they can line all their ducks in a row, a sequel or remake is possible. Unfortunately MS has them tied up with the Too Human trilogy and that leaves very little resources available to commit to another big project.
