I think it has been mentioned about 10 times in this thread: Donkey Kong belongs to Nintendo, not Rare.. yes they are in Brawl, but it is Nintendo's franchise
I'm not sure if it is exactly the same, but it would be like if Retro Studio worked for Microsoft, Nintendo would still own the Metroid series, even though Retro developed for it
