It's not a fatality if the animal in question is still alive. There is a difference between being "clinically dead" (which is impossible to verify, these people couldn't check the vitals on a dog, they barely know their own butts from holes in a ground) and being dead.
The average person isn't qualified to say something is dead unless it is very obviously dead, as in the case of massive and severe torso trauma or decapitation.
