If he really did make the game with Game Maker and did just use modified Game Maker sprites, that does explain it. In that case, the creators of Game Maker would have grounds for a legal case against both Bob and whomever provided him with the means to put his game on the DS, should it ever get a commercial release. Said provider of the means would of course be Nintendo.
