If you mean that he got the movie from a "source" that is not legal, no.
If you are talking about downloading a program that will change or alter your Xbox OS or firmware that allowed cheating, yes it possible to get banned for this.
If you are talking about the Microsoft update to actually play .avi or other movie formats, no. Microsoft provides the update.
