What is "winning"?
Are you implying that the 360 will sell so much more and the Wii so much less that the 360 will pass the Wii's total numbers in the next 3-4 years remaining for significant sales of this generation?
There are many flaws with your argument, I will name two.
1. The 360 is cheaper and it has a better online experience.
These two cancel each other out. To own a 360 and get the better online experience you need to pay more than what the Wii costs. There is also no evidence that the lower price or the "better" online experience will contribute to the 360 selling more than the Wii.
2. You're assuming that what you like, or reviewers like (better library?), is what everyone likes or, more importantly, everyone buys.
The idea that publishers will blame Nintendo for lackluster sales, and move titles away from Wii, is immature. Publishers and developers realize "“We've got work to do on the Wii.” (Peter Moore) If anything, it's taken 2 years for them to catch up after their mistake, now we are starting to see major releases: Monster Hunter 3 and DQX (2 of Japan's biggest franchises) The Sims (1 of America and Europe's Biggest franchises)
Guitar Hero sells more on Wii (The largest franchise), Sonic sells more on Wii, Shaun White sells more on Wii, Rayman Raving Rabbids is one of Ubisoft's most profitable series, etc. etc. etc...
My point is that, third parties can and do make money off of Wii, they have and will release(d) major games for Wii; they're just not games YOU like.
I would cite regulation, but I know you will simply ignore it.
