I would imagine the movies that are taken off of netflix are ones that M$ is trying to sell through live. I mean it would totally piss off all of the movie deals they have up until this point if you can rent them free or pay for them through the service.
More than likely this is the case, and I would bet in the near future this will be taken care of internally by M$.
