 Given that Suda games don't sell very well and are not likely to get sequels it is easy to imagine they don't have any claim to this game. It is likely the original contract had no provisions for any sequel at all as there was no reason to expect one at all. So it might be less of an issue with Ubisoft letting the property go and more of an issue of them not being aggressive enough in getting publishing rights for the sequel.
