1up Madden Review 9/10 (PS3 only 30 FPS)

I don't understand why developers don't try to keep games at other FPS levels other then 30 or 60. Why cant they do 40FPS, is it bad to have a game run at 40FPS? IF you cant get a game to run at 60 but you can get the game to run at 45FPS why not let it run at 45FPS instead of lowering it to 30FPS?
