It really depends how the contract between Nintendo and Disney is written. If Nintendo was smart, they made it so no Disney licensed characters may appear on a competing console/handheld regardless of the developer/publisher. That basically means they cannot licence Square use of their characters to appear on Sony hardware and forces Square to make it on the Wii or DS if they want to continue using Disney characters and worlds.
After saying all that however, the major problem seems to be that people don't realize there is not an agreement between Nintendo and Disney. The recent Pirates of the Caribbean game was multiplatform and that is a Disney. Turok is also supposed to hit the PS3 & 360 and is published by Disney under Touchstone Studios. There is no formal agreement, only likely a comment from Disney about continuing support on Nintendo hardware (they are apparently the 2nd leading publisher on the DS behind Nintendo). That doesn't mean they have any plans to go exclusive.
