I think it's because games released earlier in the consoles life cycle(particularly the first of each genre) get over-rated, like Perfect Dark Zero.
If ToV is an 8/10, ES is a 3/10 imo, and I play a shitload of these games.
I'd probably give ToV a 9/10(or a 9.5 for me personally) and ES a 6.5/10, which means I didnt' like it very much at all. I found ES very shallow and unrewarding, and at about 10 hours, it loses steam completely.
