But it would make it so any games that used the top touch screen would be unplayable on older DSes, all 65 million of them, hence why this wouldn't work if this functionality was added.
A redesign with a different screen size could still work, as games could be resized and all, but new functionality is something that would cause huge problems as it would create a software divide.
