3rd parties should be begging to be in it. The fanboys who normally only buy NIntendo Games will see this as a reason to buy games with the characters featured. Part of the reason SC:Legends probably has so much buzz on the Official Nintendo forums.
I personally wouldn't care too much (though Mega Man would be so bad ass).
I would cite regulation, but I know you will simply ignore it.
