It is mandated that if tips don't make up the difference between the nominal wage and the federal minimum wage the employer pays the difference. So regardless the absolute minimum is the same as everybody else and in many cases waiting staff can make much more than that through tips.

So I shouldn't need to tip because they'll be getting minimum wage to the employer then correct? Then why the hell are these types of workers get so fcking mad if you tip them poorly???
That's what I find the problem with that workfield.
The employer - if they pay their employees better than they wouldn't be starving for tips but they're cheap and rely on their customers to help pay their employees instead.
The employees - they agreed to work for the minimum wage so they shouldn't bitch and complain if you get lousy tip, because it's just a tip afterall. And if they were suckered into working with less pay because their employer says they'll make more from tipping then that's just how the business is.
If I had the power I would make a law for no more tipping and just make the employers pay more fairly then. Also customers hate that feeling on deciding how much they should tip because they feel they'll get judged for tipping poorly or something.
It's the customers that gets the most screwed in this business.
