If there was a psychopath on the loose, harming and killing other people, would it not be sensible and rationale to kill him (hypothetically assuming that it is the only way to stop the psychopath)?
If one was a police officer or soldier, entrusted with the duty to save as many lives as possible, would it not be their responsibility to kill the psychopath?

If one is an unfortunate victim of an experiment being shot at by the military does it not make sense to kill the military?

No, because even though the experiment being/psycho is not resposible, it is not even a matter of guilt and punishment when the military killed him. They simply took the course of action that would prevent more innocents from being harmed (1 innocent victim, vs 1 innocent+more).
A better counter question would have been to focus on utilitarianism and the organ donor question.
