ZodTTD? I've heard of him before. He's made some emulators for the Gamepark handheld devices. They're pretty good from what I understand.
Unless it supports the classic controller (not just the wiimote) my money is on the controls being awful.

If you read the app description at the appstore they say that is the user's responsibility to use the games or smth

in the US it is illegal to mod a console since it is circumventing DRM. They won't do anything to you other than make new firmware updates to remove the mods. They would legally go after someone who was selling hard mods within the US. They tried to do that recently over in Europe (can't remember which country, but it was for the R4 card) and they lost as they don't have the same laws as in the US.

Emulators are perfectly legal in the US. What is illegal is the games themselves (ROMs and the like) + any type of copyrighten bios (like the ps1/ps2 etc) You can legally download a PS1/PS2 emulator and dump YOUR bios from YOUR console to use with the Emu, as well as use the games you own on the emu. If anything, they would go after Apple for selling this Emu, not for allowing it to be a usable app.
EDIT: From Nintendo's side, the only thing they really can do is not allow Apple to sell their games without their permission.
It seems that it only lasted a couple of hours Apple shot that app down from appstore lol
