No he can take his HDD out,and swap it in his new PS3. His stuff should still be on it.
If you did a full system backup (rather than just saving your save games to a flashdrive) the PSN game will also be restored.

No it reformats the data. It's a piracy protection thing. He can redownload any games he bought but his saves are gone.

You're not lieing, but your statement is misleading. MS fixes 'RROD' at no charge, but other problems they do not. Which I'd think it makes the warranties actually very similar.
Call up sony, ask for a quote on how much it's going to cost you with shipping, try to get them to pay for it. After you know the cost then make your decision, on whether to ebay it and get a slim. Tell them you want the saves intact. A PS3's still a PS3 - fat or slim.
