The issue is we don't know the deal that was signed by Bioware and M$...what we DO know is that M$ spoke about them having a deal, when Bioware was first bought by EA. Now...they might be trying to wiggle out of it, but clearly, if there wasn't something in writing, the game would have been billeted as multi-console format. Maybe it's an exclusivity deal on consoles, and not extended to the PC, but I don't think it's timed like the Japanese deals. The original game was published by M$ on the console, and EA on the PC. To refresh the issue, back at the end of 2008, it was announced

that EA would publish the game on the PC and Console…so…do people honestly believe that M$ just willingly give those rights back to EA, for a game that is probably going to ship well over 2 million games for free? EA is a company struggling to make a profit, and getting those rights back is going to be a sizable deposit into it’s profit coffers. I think the game is going to be bigger than Fable 2, and M$ smarten up, after Tecmo was able to wiggle out of it’s contract of exclusivity for Ninja Gaiden. In this case, the game was pitched to M$ as a trilogy…if M$ didn’t sign an ironclad agreement to ensure its exclusivity, they deserve to lose it.
