Not yet but any day, you would be mad to download it and play it this early though, they WILL ban people that do it this early just like they did with gears 2, wait until the release day then download burn and play!

the only reason people got banned when they played gears of war 2 was because they played it BEFORE the official release date, MS knew the game was being downloaded so started banning people, no one got banned for playing pirated (stelthed) versions after the release date,  it's common sense, play early and you will get caught,

My flashed 360 has been going for 3 years (i do keep it updated though), no issues at all and i play looooads of games (never early though), I play retail and pirate games, same as all my friends, none of my friends have ever been banned from xbox live,

And before some of you start moaning at me for playing pirate games, I do also buy retail games, I have DiRT 2, Forza 3, MW2, LFD2 etc on pre order and have bought a lot of retail games over the years, I tend to download and play less known games mainly, if i really like them I go out and buy them if I have the money, games that turn out crap I never go and buy, simples!
