From personal experience, I'm fine in situations where I am 100% sure than nothing terrible* can happen. A courtroom could be considered to be "safe", in a sense, though I can't really comment further on this, because if I were to take out a lawsuit against someone who wronged me, it would be at the persuasion of family and / or friends.
Part of overcoming Agoraphobia is getting over the idea that certain ventures can only fail. Perhaps the lawyer has increased the plaintiff's confidence so much that the plaintiff is willing to go through with it. I do fear for the plaintiff though, because it's quite likely that a bad result from this would profit all legal teams involved, and thus worsen his condition, due to the realisation of being taken advantage of.
