Im sure this is just another way to scam some $ from Sony since America is Land of the Lawsuits. If this person win or lose the case, he can just make another account couldnt he and he's back to doing exactly what he was doing before minus the 'social' friends list lol

I believe when they ban you from the PSN they ban your system, so he would have to buy a new PS3. And no, he won't win.

Sony usually only ban first offenders for a short period of time- around a week. You're sent an email explaining that your misconduct was in breach of the rules laid down in the online user agreement - threatenting behaviour, sexual harrassment or racial comments/slurs etc.
You can also be banned from specific online services, like the RFOM online service for example. You would still be able to play other games and use other online services during that time though.
You can usually just make another account to bypass these type of bans.
It seems like it might have just been his account that was banned, not even his IP.
