Your 360 is telling you that your not worthy of the Gears games. The AI in the 360 is highly advanced and since enough people own Gears now it is weeding people out. Except defeat.

My copy of Tomb Raider Underworld is scratched all to hell. I rented it, and installed it, and now it works great. Rent a copy and intall. You'll be fine. You just can't delete it or you'll have to rent it again. If you're feeling really balsy, you can attempt the old switcheroo.........
