Sadly this article makes Microsoft seem extremely guilty. Which they might be.

Actually they built their own software, it was just apparently to similar to someones patent. If they would have just bought it, then they wouldn't be having this problem.
A lot of these so called companies just buy up patents that they think may be usefull in the future. When someone comes along with a similar tech, they sew for damages and make millions on something they probably have little $, time, or investment in. I think they are called patent farms. I am not sure if that was the case here, but I know Sony, M$, and Nintendo have all been hit by these patent farms in the past.

I know M$ can take it, but I'm not sure if the XBOX division can though

This suit has nothing to do with the xbox division, fission mailed for your stealth troll.
They haven't lost all that money yet. Last paragraph last sentence microsoft is going to appeal. So it's not a loss yet.
