Actually they built their own software, it was just apparently to similar to someones patent.  If they would have just bought it, then they wouldn't be having this problem.

 

A lot of these so called companies just buy up patents that they think may be usefull in the future.  When someone comes along with a similar tech, they sew for damages and make millions on something they probably have little $, time, or investment in.  I think they are called patent farms.  I am not sure if that was the case here, but I know Sony, M$, and Nintendo have all been hit by these patent farms in the past.
