They have held Captain Richard Phillips captive, threaten Congressman, held ships on the high seas impeding int'l trade in the Gulf of Aden, and have promised retaliations.

Personally, I would have them tried as terrorists and have the ROE against them be take captives or shoot on sight if the forces are at risk.  These guys are strict Wahabis and are terrorists.  Anyone remember Black Hawk Down?

oic, tbh i would be very careful about who you classify as a terrorist or not, i also only know a very small amount about the Somailis, so wihtout knowing more, i wouldnt want to venture a classification of them.

The were getting ready to fire into the Cpt. w/ AK-47s when DEVGRU were given permission to fire at will.

The only option they were given was to release the hostage and to surrender. Not exactly an enticing option.

Essentially if the pirates are to be defeated stability is needed on the land, however doing it by force has been tried in the past and failed badly.
