Afghanistan’s President, Hamid Karzai, has signed a law which “legalises” rape, women’s groups and the United Nations warn. Critics claim the president helped rush the bill through parliament in a bid to appease Islamic fundamentalists ahead of elections in August. In a massive blow for women’s rights, the new Shia Family Law negates the need for sexual consent between married couples, tacitly approves child marriage and restricts a woman’s right to leave the home, according to UN papers seen by The Independent. [...] The most controversial parts of the law deal explicitly with sexual relations. Article 132 requires women to obey their husband’s sexual demands and stipulates that a man can expect to have sex with his wife at least “once every four nights” when travelling, unless they are ill. The law also gives men preferential inheritance rights, easier access to divorce, and priority in court. A report by the United Nations Development Fund for Women, Unifem, warned: “Article 132 legalises the rape of a wife by her husband”.

It takes away rights and independence and that is very bad... But I don't think it counts as rape tbh.

from my understanding if you are married and you want to have sex but your wife doesn't it doesn't mater because her opinion doesn't count so you can fuck her anyway, i think that's rape!! but it's just my opinion

It is spousal sexual abuse, and that is still abhorrent. Anyway, increasing and protecting women's rights had been one of the significant achievements of the new government and constitution. For example, a certain number of the seats in both the legislative bodies has to be occupied by women. It is most unfortunate that this statute has passed.

i think that it's crasy, rape should be rape no matter what the situation is

The perpetrator may be charged with related crimes such as assault, battery, or spousal abuse. It is also known that even if a spouse has an illness causing an inability to sexually respond, the other spouse may engage him or her in conjugal relations without criminal liability. There are other criminal charges that may be inapplicable to married couples. For example, in the U.S., marriage precludes a charge of statutory rape even if one of the spouses is under the age of consent in the jurisdiction where the sexual act takes place.

I think the point people are trying to get across is that it doesn't actually legalize rape. If a man grabs a woman and pulls her into an alley and rapes her, that is still illegal under these laws. It's strictly having to do with spousal relationships, which is not nearly every case of rape out there, so rape is legal only in certain conditions.

It's not just your opinion, IT IS RAPE. Forcing someone to have sex with you against their will IS rape even if she is your wife. This is just sickening.
