Why would the game say "New" on the case at all? What game was this? Gamestop doesn't put a "new" label on any of their games as far as I know. Also was this game shrink wrapped at all? If it was then the culcprit is actually the manufacturer of the game, not Gamestop.

There is always more to the story when I comes to Gamestop complaint..
when I worked at Gamestop I would have people say: "it's open so it's not New" or "it's open, can I get a disscount"
As long as the game was never played, it's considered New. An open boxed game plays the same as a sealed game. Like when you buy a new Car, you know how many people sat their sweaty ass in those seats before you did.. but the car is still New!.
I came across so much BS when working at Gamestop..
I remember 2 soccer moms coming to the store a couple days after that Janet Jackson (Super Bowl Nip Slip), they were holding Starbucks coffees talking about how "inappropriate" it was that her Nipple popped out, WHILE paying for their kids copy of GTA, I explained that it's rated M for mature... they didn't care.. "why kid won't stop asking for it"... just damn..
I would also have many people coming into with scratched 360 games, claiming they "never touched the 360, the game just got a perfect circle scratch"..
I would say "I'm defecting your old copy for you and giving you a new copy regardless if you moved the 360 or not, because I don't care"

I just get sick and tired of Gamestop horror stories (even tho I don't work for them anymore), It's to easy to complain about a store that gives you so many buying / selling options.
Unlike a Wal*Mart, Target, etc: were you just walk in, buy, walk out, nobody in one of those stores talks about games when you go in..
When you walk into a Gamestop, you have Gamers selling you games, and they will express their opinions with you when you buy a game.. and some people just don't want to hear that the game / system they are about to buy isn't the greatest..
So walking into a Gamestop can be like walking into a live game forum..
