It's completely reasonable to assume people just haven't heard of God of War. I know it's hard to believe but not everybody plays video games.
That's very true - if they had just randomly come out of nowhere with the complaint than it'd be feasible, but the write-up says they were in talks with Sony, and further, SCEA. You'd think they'd at least follow that up to ensure that they didn't get conned out of their work.

Also - OMG! A GREEK WAR GAME AND A GREEK WAR PLAY REVOLVE AROUND THE SAME GREEK GOD.... who'd of thunk the war god would be in both stories...

you could argue that, I suppose, but seeing as "The plaintiffs allege that in 2002 they sent their work to Sony Pictures as well as agents who also did business with SCEA." I think it's a pretty safe bet that they knew at least a little about GoW before this
