This wouldn't surprise me at all, but even if Ubisoft was at fault the contract they signed would (likely) be written in such a way that it would be difficult to be successful with a lawsuit

well...ive had a look around and found this (and only this):

Respondesign demands $26 million from Ubisoft Entertainment, claiming it failed to market and deliver the "My Fitness Coach" video game for the Wii and PlayStation 2 in time to coincide with the release of the Nintendo Wii Fit game, in Los Angeles Superior Court.
