And that is pretty much why Viacom is guaranteed to lose. However, it won't make a big difference in the series. The only thing is that Viacom will have to give some royalties to Konami.

The difference between this and all the frivolous law suits is that Konami has working machines, a proven capacity to produce and distribute, and a final product. Activision pays or has some type of agreement with Konami for the use of music peripherals.

Maybe, depends on what Konami wants. If Konami wants to bury Rock Band, they totally can. They hold the patent. They can order a complete stop of production of all Rock Band products as well as Rock Band 2.
I wonder if Activision tipped Konami off to prevent Rock Band from getting bigger than GH.
Not the first time Konami has done this either; does anyone remember how they killed off In the Groove for copyright infringement of Dance Dance Revolution? That was a sad day for gamers, even though Konami was legally in the right.
