While for various other reasons, I doubt this case will succeed, he only *received* the patent after the DS was released. It may have been filed YEARS earlier, which would remove prior art claims.

Plus there were games on the Palm using a stylus long before the DS existed. Heck, I'll bet the first stylus computing device had a game as one of its first applications.

touchscreens were invented and patented in 1971(with &without stylus style)

nintendo has the license from the original patent i bet.
