Does this mean that the FTC isn't a requirement for the merger agreement?
So if FTC still doesn't approve after everyone else, they'll simply verbally waive the FTC requirement away and close the deal?

MS already came out and said if the EU and CMA pass the deal then they will close, then the FTC can sue if they really want to. Although that could just be talk to push the FTC into investigating to the point of realising how much of a waste of money that would be.
