FTC basically just makes the argument that any acquisition means one independent economic operator less. That's also the CMA approach. But we haven't heard anything so far from them that makes a substantial lessening of competition reasonably likely.

Judge wants to know why Nvidia would do that deal.

FTC: they got a deal for Microsoft's own contract. That is not merger-specific, they could have done that anyway.

I'm very optimistic that Judge Corley will give significant weight to the existing agreements and remedies, and if the FTC runs to the 9th Circuit to appeal the denial of a preliminary injunction, it'll make the legal argument that such agreements should be ignored.
