Lol...FTC's lawyer was talking about 1 metric (out of 3) specifically, they pointed out that they exceeded that metric target (for Xbox) but Satya responded "We set it low" 😭😂

So far it's all just about Microsoft recently having been pretty successful with the Xbox division.

It feels so stupid for FTC to focus like 70% of their effort on the Console Market SLC. It's so hard to prove and practically everyone with any sense dropped it, including UK and Europe, Lol. You have to prove first that Nintendo isn't in the market, then you have to prove that Xbox WOULD take COD from PS and then you have to prove that PS would be SIGNIFICANTLY hurt by it, Lol.

Now another expert economist working for Microsoft, Professor Dennis Carlton. FTC brings up he worked 600-650 hours for Microsoft on this matter at a rate of $2000/hr.

This, too, is pretty common in U.S. antitrust cases. If other judges previously threw out part or all of another opinion by the same expert, lawyers try to use it to diminish an expert's credibility.

FTC trying to discredit him as a witness. Smartest thing they've done so far. Would be a big blow.

Professor Carlton confirms he is not (because another expert is) giving an opinion on the relevant antitrust market in this case.

The real issue with those expert fees is that the FTC and the CMA basically created an Economic Expert Full Employment Program with their overenforcement, requiring the merging parties to explain things that should have been obvious after the first few weeks of a review.
