Yeah it's misleading, the FTC stated that PewDiePie's disclosure was not adequate, I fail to see how this is any different. This sort of thing has been going on for a while, it used to be CGI used to make a game look better now they just use the PC version on highest settings.

I get that if you're a PC centric, or more tech savy, user then you're more attuned to how a game will be different comparative to your spec, but most console users wont think about that. They'll see an ad for Gears on XB1S and expect that's what it'll be like on that system, which to be fair is not an unreasonable assumption.

To that end though I don't think many people will notice/care once they're playing the game.

It's going to be very interesting however to see how this is handled going forward with Neo and Scorpio.

Yes. Like Sony does and did for most of its best looking games running on PS4 and PS3. "This footage was recorded in real-time on a standard PlayStation 4." - or something like that. I've seen it at the beginning of many videos. And don't worry, once the Scorpio will be out be sure MS will do the same with the footages recorded on it. That video is misleading the least.

It's worse, PewDiePie's channel isn't titled "Unsponsored Content" so you wouldn't assume from the channel's title the footage was unsponsored. 

This channel is titled "Xbox" so you'd assume the footage would be from an Xbox.

I fail to see how this is relevant... it was an in-engine cutscene running on a ps4 at 60fps, it wasn't gameplay, and at the time that footage dropped Naughty Dog were targetting 60fps IIRC.

Whats misleading? It clearly says "This gameplay premiered at Gamescom 2016 and was captured on a Windows 10 PC in 4K resolution with an NVIDIA GTX 1080 GPU. "

Misleading would be putting up a trailer saying "Gears of War 4 Xbox console gameplay trailer" and then showing 4k PC gameplay.

But it's on the XBOX channel, and it's being used to advertise the sale of an XBOX. Seems weird to me.

It was running in real time on a PS4, and it was at 60 fps. ND was aiming for 1080p60fps, then they dropped it and it was plenty advertised. No lies there. MS is using PC footages, hides it in the description only few read, especially from mobile, and it isn't the first time they show videos in the Xbox channel not made in a Xbox. Once they even showed PS4 footage (so they are either liars or incompetent).
