As far as I know both Kojima Productions and Fox Engine are owned by Konami. So technically if Kojima wanted to make a game with Fox Engine, while his new Studio is not a subsidary of Konami, he would have to pay Konami for the Engine.And I think Konami doesn´t sell licenses for their Engines... a.k.a 100% inhouse use for their engines.
