You're right, it would be a hassle. But I feel that the idea of it is still helpful for both the confidence of the backer and the conscientiousness of the creator. A creator who's not so good at planning might think twice before diving headfirst into Kickstarter knowing that they're entering into a legal obligation, even if the chances of them getting sued are decently slim. There are plenty of laws and rules we observe that we know will likely not ever bite us in the ass, but their existence still acts as a very good deterrent.
