It was funded and published by Nintendo. With Nintendo developers helping during the development. They also owned the IP.
Is basically the same as F-Zero GX, Star Fox Assault and Zelda: Minish Cap, all these were developed by 3rd party companies.

I own all those games except the Batman games (i have them on PC)

That does not make it a bad game, is actually pretty good. It has some issues, specially technical ones but the plot, boss battles and optional missions are very good. If you did not like the other games on the franchise this will not improve things, but if you did like them this is just more batman fun.

Out of that list, I have all retail games except for Injustice: Gods Among Us, I don't have eShop games because I don't buy digital only games. And I agree, all deserve better sales, specially AC IV and Rayman, Ubisoft is doing a great job on the console and it should get also better support from the buyers.

Technically this game is not third party as it was published by Nintendo, but it does deserves to sell better, I have it on my to buy list.
